Please read these Terms and Conditions (“Terms”) carefully before using Zyfoo Commerce, a SAAS product (“the Service”) provided by Zyfoo Commerce (“the Company”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Service.
1.Use of the Service
1.1 Eligibility: You must be at least 18 years old and have the legal authority to enter into these Terms to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
1.2 User Account: You may need to create a user account to access and use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account.
1.3 Acceptable Use: You agree to use the Service in compliance with these Terms, applicable laws, and any additional guidelines or policies provided by the Company. You shall not engage in any activity that disrupts, interferes with, or harms the Service, its users, or any third parties.
2.Intellectual Property
2.1 Ownership: The Service and all related intellectual property rights are owned by the Company. You acknowledge that you have no ownership or intellectual property rights in the Service except for the limited license granted to you under these Terms.
2.2 License: Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.
2.3 Restrictions: You shall not, directly or indirectly, modify, reproduce, distribute, create derivative works of, reverse engineer, decompile, or disassemble the Service, except as expressly permitted by applicable law.
3.Payments and Subscriptions
3.1 Fees: The use of certain features or functionalities of the Service may require payment of fees. You agree to pay all applicable fees in accordance with the pricing and payment terms provided by the Company. Failure to pay fees may result in the suspension or termination of your access to the Service.
3.2 Subscription: If you subscribe to a recurring payment plan, you authorize the Company to charge your designated payment method automatically on a recurring basis until you cancel your subscription. You are responsible for canceling your subscription before the next billing cycle to avoid further charges.
4.Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. The Company disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Company does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
5.Limitation of Liability
To the maximum extent permitted by applicable law, the Company and its affiliates, officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, arising out of or in connection with the use or inability to use the Service.
6.Indemnification
You agree to indemnify and hold the Company and its affiliates, officers, directors, employees, agents, and suppliers harmless from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
7.Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Pondicherry Court, India. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in accordance with the rules of authenticated arbitration company. The arbitration shall take place in Pondicherry. The prevailing party in any arbitration or legal proceeding shall be entitled to recover its reasonable attorneys’ fees and costs.
8.Amendments and Severability
The Company reserves the right to modify or update these Terms at any time, without prior notice. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
9.Entire Agreement
These Terms constitute the entire agreement between you and the Company regarding the use of the Service and supersede any prior or contemporaneous agreements, communications, or representations, whether oral or written.

These additional terms apply when you access or use the Puthaiyal mobile application, its website links, and related treasure-hunt services (together, the “Puthaiyal Service”). Puthaiyal is powered by Askan Technologies and made available through Zyfoo. Each hunt is conducted by the organizer identified in the app. These Puthaiyal terms supplement the Zyfoo Terms and Conditions above. If event-specific rules are displayed for a hunt, those rules also apply to participation in that hunt.
By creating an account, registering for a hunt, joining a team, or using the Puthaiyal Service, you agree to these terms and the applicable event rules. You must provide accurate information and be legally capable of accepting these terms. Any age restriction is set by the relevant organizer. A minor may participate only with permission and supervision from a parent or legal guardian. A team lead is responsible for ensuring that their team members understand the applicable event and safety rules.
You are responsible for keeping access to your registered email address, one-time passwords, device, and account secure. Do not share an OTP or impersonate another person. We may limit simultaneous sessions or device access where reasonably required for account security, event integrity, or fraud prevention. Organizer and tenant-owner accounts may have elevated permissions and must be used only by authorized persons.
Submitting a registration does not guarantee entry. The relevant organizer may approve, reject, or request resubmission of a registration in accordance with the event rules and capacity. Organizers are responsible for their event description, schedule, registration window, routes, stops, clues, approvals, prizes, venue access, and participant communications. An organizer may reasonably change an event time, route, stop, clue, assignment, or operational instruction because of weather, traffic, road closure, public safety, venue restrictions, or another unforeseen circumstance.
Participation may involve travel, roads, public places, physical activity, and changing local conditions. Always obey traffic laws, official directions, property restrictions, and safety notices. Do not trespass, enter a restricted area, take an unsafe route, or use a phone while driving. A driver must concentrate on driving; navigation and app use should be handled by a passenger or only when the vehicle is safely parked. Stop participating and contact the organizer if a location or task appears unsafe or inaccessible. In an emergency, contact the appropriate local emergency service.
A racer or team may receive an assigned route and clues progressively. QR codes, location checks, photographs, and organizer review may be used to confirm progress. Do not copy, alter, share, or misuse a hunt QR code, clue, route, or answer; falsify a location; interfere with another team; or use automation or another unfair method. If a stop cannot safely be reached or scanned, an organizer may, at its discretion, manually approve or reject that stop. Manual actions and organizer comments may be recorded in the event history.
With your permission, Puthaiyal may access the camera to scan QR codes and take event or team photographs. Where an organizer enables a location check, the app may use your device location at the relevant stage to verify proximity to a stop. You may control permissions through your device settings, but disabling a required permission can prevent the corresponding feature from working. The app does not guarantee that GPS, camera, connectivity, or QR recognition will always be accurate or available.
You retain ownership of photographs and other content you submit. You grant us and the relevant organizer a limited, non-exclusive licence to store, transmit, display, and review that content only as reasonably needed to operate the hunt, verify completion, resolve disputes, maintain security, and provide the Puthaiyal Service. Publicity or promotional use should be based on any separate consent or event notice presented to you. Do not upload unlawful content or content that infringes another person’s rights, and obtain permission from people included in a photograph where required.
Completion may depend on the assigned route, required scans or manual approvals, required photographs, and any final organizer verification. Timing and progress shown by the service may depend on device and network conditions. The organizer determines event results, tie-breaking, disqualifications, and prize eligibility under the disclosed event rules. Any fee, refund, prize, or reward is governed by the relevant organizer’s disclosed terms unless Puthaiyal expressly states otherwise.
Puthaiyal and the organizer may send operational email, push, or in-app messages about registration status, schedule changes, clues, safety, approvals, and event administration. Delivery can be affected by connectivity, device settings, email providers, and third-party notification services, so you should also check the app and follow organizer announcements. You are responsible for keeping your contact information current.
We may maintain, update, suspend, or restrict the Puthaiyal Service where reasonably necessary for security, legal compliance, event integrity, or technical operation. We or an organizer may suspend an account or remove a participant for cheating, unsafe conduct, abuse, unauthorized access, breach of these terms, or interference with the service or event. Events may be postponed, shortened, changed, or cancelled for safety, operational, legal, or force-majeure reasons.
The Puthaiyal Service may process account details, contact information, team and registration information, route assignments, progress, QR scans, organizer actions, submitted photographs, device notification tokens, and limited technical or security records. Processing is described further in the Zyfoo Privacy Policy and any event-specific privacy notice. Do not submit sensitive information unless the app expressly requests it and it is necessary for the event.
You can request deletion from the app by opening Profile, selecting Delete Account, and confirming permanent deletion. If you cannot access the app, email digital@askantech.com from your registered email address with the subject “Delete my Puthaiyal account”. We may ask you to verify account ownership before processing the request.
Deletion removes or de-identifies the Puthaiyal account and associated profile, contact and team details, hunt registrations, route assignments, progress and scan records, submitted event photos, notification records, device tokens, and active sessions. If the account owns an organizer tenant, deleting it may also remove that tenant’s hunts, routes, stops, registrations, and related records; the app will explain this consequence before confirmation. Limited records may be retained only where reasonably necessary to meet a legal obligation, prevent fraud or abuse, protect users, resolve a dispute, or maintain an anonymized security audit. Requests submitted by email are normally processed within seven working days after successful verification.
The Puthaiyal Service is provided on an “as available” basis to the extent permitted by law. Maps, location, network, notifications, timing, and third-party services may be delayed, unavailable, or inaccurate. Puthaiyal does not control public roads, venues, weather, traffic, or participant conduct. Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that restriction, Zyfoo, Askan Technologies, and their personnel are not liable for indirect, incidental, special, or consequential loss arising from use of the service or participation in an event.
Your use of the app may also be subject to the applicable Apple App Store or Google Play terms. The app may use third-party map, notification, authentication, hosting, email, camera, and analytics services, which may have their own terms and privacy practices.
We may update these Puthaiyal terms to reflect service, legal, or safety changes. The updated date will be shown above, and material changes may also be communicated in the app or by email where appropriate. These terms are governed by the laws of India. Subject to mandatory consumer rights, courts with jurisdiction in Puducherry, India will have jurisdiction over disputes relating to the Puthaiyal Service.
